Terms & Conditions

These terms govern online purchases, reorder requests, and auto-reorder subscriptions made through this website.

1. About these terms

These terms and conditions form a legally binding agreement between you and Martin Grimbly Optometrist ("we", "us", "the practice"), an independent optometry practice at 3 Church Street, Arauna, Brackenfell, Western Cape, 7560. By submitting an order or enrolling in a subscription through this website, you confirm that you have read, understood, and accepted these terms in full.

For clinical services provided in-practice — including eye examinations, contact lens assessments, and spectacle dispensing — separate professional terms apply as communicated at the time of your appointment.

Nothing in these terms limits or excludes rights you hold under South African consumer protection legislation, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECT Act). Where any conflict exists, the applicable legislation prevails.

2. Prescription requirement

Contact lenses are classified as medical devices and may only be supplied against a valid prescription. By placing an order for contact lenses on this website, you confirm that:

  • You hold a valid contact lens prescription issued by a registered optometrist or ophthalmologist.
  • Your prescription is no more than 12 months old at the time of ordering.
  • You are ordering lenses that match your current, valid prescription exactly — including lens brand, base curve, diameter, and power.
  • If you are a new patient, you must upload your prescription when submitting your order. We will verify it before processing.

We reserve the right to decline or cancel any order where we cannot verify that a current, valid prescription is in place. If your prescription has expired, we will contact you to arrange a contact lens assessment before proceeding with your order.

3. Placing an order

Submitting an order form or completing a payment checkout constitutes an offer to purchase. A binding contract is only formed when we confirm your order by email and your prescription has been verified by our staff.

We reserve the right to decline any order, including where stock is unavailable, prescription verification fails, or a payment issue arises. If payment has already been taken for a declined order, a full refund will be processed within 7 business days.

Order confirmation emails are sent automatically after checkout. If you do not receive a confirmation within one business day, please contact us to confirm your order was received.

Personal information you submit during an order or subscription is handled in accordance with our Privacy Policy.

4. Pricing and payment

All prices are quoted in South African Rand (ZAR) and are inclusive of any value-added tax (VAT) that applies. Prices are subject to change; the price displayed at the time your checkout is completed is the price that applies to your order. Delivery charges (where applicable) are shown separately during checkout and are in addition to the product price.

Payments are processed by PayFast (DPO PayFast (Pty) Ltd), a registered South African payment service provider. We do not store your card details at any point — PayFast handles all card data on their PCI-DSS compliant platform.

Medical aid claims. If you choose to claim from your medical aid, no payment is taken at checkout and no price is shown, because the amount you owe depends on what your scheme covers. We confirm your available benefit with your scheme, then email you the balance payable together with a secure payment link. Your order is only processed once that balance is settled — or, where your scheme covers the full amount, once the claim is confirmed. You are under no obligation to proceed once we quote you the balance, and you may cancel at that point at no cost.

5. Fulfilment

Collection

Orders selected for in-store collection will be made available at our Brackenfell practice. We will notify you by email or phone when your order is ready. Collection is available during practice hours: Mon–Fri 08:30–17:30, Sat 08:30–13:00.

Delivery

Delivery orders are dispatched via courier to the address provided at checkout. Delivery fees and estimated timeframes are displayed at checkout. Once an order has been handed to the courier, we are not responsible for delays caused by the courier. Risk in the goods passes to you on dispatch.

Processing time

Orders are typically processed within 1–3 business days, subject to prescription verification and stock availability. We will contact you directly if we expect a delay.

6. Cancellations and returns

Cancellation before dispatch

You may cancel an order at any time before it has been dispatched or prepared for collection by contacting us. If payment has been taken, a full refund will be processed within 7 business days.

Cooling-off period (ECT Act section 44)

As an online purchaser, you have the right to cancel a transaction within 7 days of receiving the goods without penalty and without giving reasons, provided the goods are returned in their original, unopened packaging. Under section 44(2) of the ECT Act, the cooling-off right does not apply to:

  • goods once their packaging has been opened or seals broken (including unsealed contact lens packs), for hygiene reasons; and
  • specialty lenses specifically manufactured for your prescription parameters where we do not hold equivalent stock (i.e. goods made to your specifications).

Returns

Contact lenses are medical devices supplied to match your personal prescription. Outside of the statutory cooling-off period, we accept returns only where products are in their original, unopened packaging, returned within 7 days of receipt, and where the return is due to an error on our part (wrong product or prescription) or a manufacturing defect. Opened lens packs cannot be returned for hygiene and safety reasons.

Defective products

If you receive a defective lens, contact us as soon as possible. We will arrange a replacement or refund in line with the manufacturer's warranty terms and your rights under the CPA.

7. Auto-reorder subscriptions

Our auto-reorder programme lets you authorise recurring contact lens orders on a schedule you choose (every 3, 6, or 12 months). By enrolling, you authorise us to charge your card via PayFast on each scheduled date until you cancel.

Prescription check

We will not process a scheduled charge if your prescription on file has expired. Your subscription will be paused and you will be notified by email. You will need to provide a current prescription before the next charge can proceed.

Price

The price charged on each cycle is locked in at the time of your enrolment. If our standard prices change, the locked-in price applies to your subscription. If we need to change your subscription price for any reason, we will notify you at least 30 days in advance and give you the opportunity to cancel before the change takes effect.

Cancellation

You may cancel your subscription at any time by contacting us at [email protected] or by phoning the practice. Cancellation takes effect before the next scheduled charge date. Charges already processed are not refundable unless a product return qualifies under section 6.

Payment failure

If a scheduled payment fails, we will retry on a short internal schedule. If several attempts are unsuccessful, your subscription will be paused and we will contact you to resolve the payment. No lenses will be dispatched for a paused subscription.

Consent record

Your consents for auto-reorder billing are recorded in our audit log at the time of enrolment, including the exact terms you agreed to. You may request a copy of your consent record at any time.

8. Limitation of liability

To the extent permitted by South African law, our liability to you in connection with any order or subscription is limited to the total amount you paid for the relevant transaction. We are not liable for indirect, consequential, or incidental losses — including loss of income or loss of data.

We are not liable for harm arising from use of contact lenses contrary to the terms of your prescription, contrary to the manufacturer's instructions, or contrary to professional advice given to you by a registered optometrist. Responsible lens wear, hygiene, and follow-up care remain your responsibility as the wearer.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded under South African law, including your rights under the Consumer Protection Act 68 of 2008.

9. Governing law

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these terms will be subject to the jurisdiction of the South African courts. Where a dispute can be resolved through the CPA's National Consumer Commission or the relevant ombudsman scheme, we will engage with that process in good faith.

10. Changes to these terms

We may update these terms from time to time. Material changes will be posted on this page with an updated date. For active subscriptions, we will notify you directly of any material change at least 30 days before it takes effect, and give you the opportunity to cancel if you do not accept the change.
